How foreclosure works in New Jersey, and where a cash sale fits

New Jersey foreclosures go through the courts, which makes them slow. That's bad if you're waiting for it to end and good if you want time to sell on your terms.

It starts with a notice, not a sale. Before a lender can file, it has to send a notice of intention to foreclose and give you time to catch up. After filing, there's a complaint, a period to answer, and eventually a judgment before the sheriff schedules a sale. Each stage takes months. At every one of them, you still own the house and can sell it.

The sheriff sale is the deadline that matters. Once the county sheriff sets a date, that's the day the house can be sold at auction to pay the lender. New Jersey gives homeowners the ability to request adjournments, which push the date back, and a signed contract with a real buyer and proof of funds is often what makes that request credible. We provide both.

Equity disappears at auction. Houses at sheriff sale often go for the lender's judgment amount or not much more. Years of accumulated legal fees, interest and costs get paid first. Selling before the sale to a cash buyer means the lender is paid off at closing and the remaining equity comes to you, not to the auction floor.
